The Max Growth is a full-service growth and lead generation agency providing services globally. We specialize in delivering measurable results through:
Lead Generation (B2B & B2C, multi-channel including Meta Ads, Google Maps, Instagram, Facebook, LinkedIn, and cold email outreach)
Website Design & SEO (conversion-focused, modern, and performance-optimized)
Creative Campaigns (unique, attention-grabbing marketing strategies)
Paid Ads (psychologically structured for maximum conversions)
Content Creation & Social Media Management (script, shoot, edit, post, and manage campaigns locally or globally)
By accessing or using our services, you accept these Terms of Service fully. If you disagree, please refrain from using our website or services.
2. Definitions
Client: Any individual or business engaging The Max Growth for services.
Services: Any deliverables, campaigns, websites, content, or lead generation provided by The Max Growth.
Deliverables: Finished work, including websites, reports, campaigns, or creative content.
Leads: Verified potential customers generated through multi-channel strategies.
3. Scope of Services
The Max Growth provides premium growth-focused services tailored to each client. Services include, but are not limited to:
Lead Generation (verified, ready-to-engage contacts)
Conversion-focused website design & SEO
Creative campaigns and marketing strategies
Paid advertisements for maximum ROI
Content creation and social media management
Limitations:
While we provide leads and growth strategies, we cannot guarantee specific sales or revenue.
Third-party costs (ads, tools, software) are billed separately unless included in your service agreement.
4. Client Responsibilities
Clients must:
Provide accurate business information and timely approvals.
Comply with all applicable laws (e.g., GDPR, CAN-SPAM) when using leads.
Respond promptly to queries, feedback, and approvals to ensure timely delivery.
Understand that delays in client response may impact project timelines.
5. Payment Terms
Monthly Retainers:
Services are primarily provided on a monthly retainer basis, billed at the start of each month for that month’s services.
Retainer fees cover all services agreed upon in the contract.
Retainers automatically renew each month unless either party provides written notice of termination at least [X] days before the next billing cycle.
Late Payments: Services may be paused until payment is received. Late fees may apply.
Exclusions: Any costs for third-party tools, software subscriptions, or ad spend (e.g., Meta Ads, Google Ads) are not included in the retainer and will be billed separately or paid directly by the client.
Project-Based Work:
For one-time or project-based services outside the retainer, payment is split as 50% upfront and 50% upon project completion.
Project work will commence only after receiving the upfront payment.
Any additional services or changes beyond the agreed project scope will be billed separately.
Exclusions: Third-party tools, software, or ad spend are not included in project fees and are the client’s responsibility.
6. Service Delivery & Limitations
Projects are executed following our process: Listen → Plan → Execute → Deliver → Scale.
We aim to provide measurable results but cannot guarantee specific conversions or revenue, as outcomes depend on market conditions, client participation, and other external factors.
Any project revisions or changes will be conducted according to the scope agreed in the contract.
7. Intellectual Property
All materials, designs, campaigns, and content remain property of The Max Growth until full payment is received.
Clients are granted a license to use deliverables only after full payment.
The Max Growth retains rights to showcase work in portfolios, case studies, and marketing materials unless otherwise agreed.
8. Confidentiality & Data Privacy
The Max Growth will protect client data and sensitive information.
Clients agree not to share proprietary methods, strategies, or tools provided by The Max Growth.
Our Privacy Policy governs personal data usage.
9. Termination / Cancellation
Either party may terminate the agreement under agreed terms.
In case of termination, any work completed and expenses incurred up to that point are payable by the client.
Refunds, if any, will be outlined in the service agreement.
10. Limitation of Liability & Indemnity
The Max Growth is not liable for indirect, incidental, or consequential losses arising from the use of services.
Clients agree to indemnify The Max Growth against claims, losses, or damages arising from misuse of services or non-compliance with laws.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
Any disputes will be resolved under the jurisdiction of courts in Pondicherry, India.
12. Changes to Terms
The Max Growth reserves the right to update these Terms at any time.
Clients will be notified via website updates or email.
Continued use of our services after changes constitutes acceptance of the updated terms.
13. Optional Clauses (If Applicable)
Refund Policy: Refunds are handled according to individual service agreements.
Third-Party Services: Ads, platforms, or tools used may be subject to third-party terms.
Force Majeure: The Max Growth is not responsible for delays due to unforeseen events beyond control (natural disasters, tech outages, or regulatory changes).
